PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY ("Terms") BEFORE USING THIS WEBSITE or APPs relating to AREEKA WEB.

All users of this site agree that access to, and uses of, this site, are subject to the following terms and other applicable law. If you do not agree to these terms and conditions, please do not use this site. By using the AREEKA WEB site, you agree to be bound by the terms of use set out below. If you do not wish to be bound by these terms, you should not use the AREEKA WEB Site.

AREEKA WEB has the right to change its Terms of Use and privacy policy from time to time at its sole discretion and without alert or notice to you. You must periodically review the Terms and privacy policy. Your use of the AREEKA WEB Site will be deemed an acceptance of the terms existing at that time.

The Terms of Use govern and apply to your access and use of the communication platform offered by AREEKA WEB S.A.L. (“AREEKA WEB”), the AREEKA WEB services available through the AREEKA WEB Network (the “Network”) via the AREEKA WEB website, and AREEKA WEB mobile apps (“App”) (all hereinafter collectively, “AREEKA WEB” or the "Service(s)") and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Service (collectively referred to as "Content"). The terms “You", "Your,” and “Yourself” refer to the individual user of the Service.

You hereby certify that you are (i) over the minimum legal age to use the service (for guidance, but not limited to, the minimum legal age to use the service is 18 years for the Republic of Lebanon as well as Arab countries, 18 years for China, 16 years for The Netherlands, 14 years for Germany, Australia, South Korea, Spain and the United States, and 13 years for the rest of the world) and have full legal capacity and the legal ability to consent to Therapy, or have your Parent/Guardian consent to Therapy, and (ii) you recognize and warrant that you have the legal right and the ability to use the service in accordance with the law of your country or the country you exist in, and (iii) you are physically located or are a resident of the State or Country you have chosen as your current residency when creating your Account.

You agree to provide “Contact Information” (your personal contact and/or a close family member/relation) to your Therapist to act as an information source to be used in case of a mental health crisis or other emergency where knowledge of your location is crucial. You acknowledge that your ability to access and use the Service is conditioned upon the truthfulness of the information you provide regarding your age, residence and Contact Information and that the Therapists you access (“Therapist(s)”) are relying upon this certification in order to interact with you and provide the Services.

Anyone less than (18) years needs to obtain the consent of his/her parents or guardians to use AREEKA WEB, and that by submitting the email address of the parents or guardians to then enable AREEKA WEB to address them for their approval, the parents or guardians have to monitor their children's activities and be responsible for the actions of their children as long as they are under the age of 18 years. In the case that AREEKA WEB has been informed, or finds out via its own methods, that the user's age is under the legal age to create an account on AREEKA WEB, the account will temporary be deactivated until parental/legal guardian consent is obtained. The email address of the legally responsible adult will be demanded from. Te user in order to obtain this consent. If you doubt that your child takes part in any activities that collect personal information, and you did not receive any emails to notify you or request your acceptance, please do not hesitate to notify AREEKA WEB.

Site content

Other than the guidance and advice you receive directly by you from your licensed Therapist, the other educational, graphics, research sources and other incidental information on the Site, the Content, should not be considered medical advice. You should always talk to an appropriately qualified health care professional for diagnosis and treatment, including information regarding which medications or treatment may be appropriate for you. None of the Content represents or warrants that any particular medication or treatment is safe, appropriate, or effective for you. AREEKA WEB does not endorse any specific tests, medications, products or procedures.

Account registration

To access the Services, you must first register to establish an individual user account (“Account”), by providing specified information. You agree that you will not create more than one Account, or create an Account for anyone other than yourself, without first receiving permission from the other person. In exchange for your use of the Service and, if applicable, in order for Therapists to send notices to you, you agree to: (i)provide true, accurate, current and complete information about yourself as prompted by our Account registration form (understanding you may use an anonymous user name or nickname after you provide certain personal and emergency Contact Information); and (ii) each time you log on, maintain and promptly update such Account information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, outdated or incomplete, or AREEKA WEB has reasonable grounds to suspect that such Account information is untrue, inaccurate, outdated or incomplete, AREEKA WEB reserves the right to transition your treatment to another Therapist outside of AREEKA WEB or refuse any of your future request(s) to use the AREEKA WEB Services. You shall at all times remain responsible for maintaining the confidentiality of your Account password and username (if any) and any other security information related to your Account.

Your account, representations, conduct and commitments

You agree not to access or use the Service in an unlawful way, or for an unlawful or illegitimate purpose, or in any manner that contravenes these terms.

You agree not to post, raise, write, distribute, use, store, transmit, find, or publish in any way, or cause to be published on AREEKA WEB, either directly or indirectly through other sites, any of the following:

1. A message or information under a false name;

2. Information that is unlawful, libelous, defamatory, obscene, fraudulent, predatory of minors, harassing, threatening or hateful to any person.

3. Content that is considered hardcore, indecent, violent, pornographic, racist, abusive, fraudulent, offensive to any religious or moral group, or contains overtones of these things, or is in violation of privacy or publishing rights. All of these are unacceptable in any form.

4. Information that infringes or violates any of the intellectual property rights of others or the privacy or publicity rights of others.

5. Anything that would impact on the operation or security of the site AREEKA WEB or causes illogical inconvenience or disables any of the other users or our staff.

6. Transfer your account (including a page or application you run) to any person without obtaining prior written permission from us that allows it.

7. Applying any reverse engineering, reverse collect, dismantling, or any other activities that would hack the issuers or other formulas or computational processors code of the software used in the infrastructure and the processes relating to AREEKA WEB.

8. Provide personal or private information related to a third party, for example, but not limited to, family names, addresses, phone numbers, email addresses, and/or credit card numbers.

9. Broadcast viruses, subversive data, or other files that cause damage, malfunction or sabotage.

10. Provide any content or links to content that exposes AREEKA WEB, or other users, to harm or legal liability in any way. This is according to the sole judgement of AREEKA WEB).

11. Provide content that constitutes, or encourages, or provides instructions for a foul crime, or breaches the rights of any party, or causes in any way any legal liability, or any content which may constitute, cause or encourage a criminal action or violates any applicable law.

12. Provide content that is not owned by you personally without legal permission from the legal owner of that content.

13. Provide content that impersonates any real or legal person, or causes in any way, a false claim of dependency to that real or legal person, including AREEKA WEB.

14. Provide undesirable promotional materials, political campaigns, advertisements, contests, raffles, or offers.

AREEKA WEB does not assume any responsibility or acknowledgement for any content published, uploaded, fostered, distributed, stored, or created by users, in any way on AREEKA WEB site directly or through other web sites.

Neither AREEKA WEB, nor its affiliates, are under any obligation to respond to messages posted on the Service. You are solely responsible for the information or material you post on the Service.

AREEKA WEB does not take any responsibility for any content published, stored or uploaded in groups or interactive pages (social pages) by you or by any third party, or for any loss or damage resulting from it,. AREEKA WEB does not take responsibility for any errors, vilification, contempt, defamation, omissions, lies, pornography, or insults that may come across during your use of interactive pages (social pages). AREEKA WEB does not take any responsibility for any statements, representations or content provided by users in any public interactive pages (social pages). Users must inform AREEKA WEB immediately to take the procedures necessary, according to its discretion.

If there is an emerging complaint about content that a user has published, or causes to be published, submitted, broadcasted, distributed, stored, or created, on AREEKA WEB site directly or through the website of third parties, you agree to direct your complaint against the user only and not against AREEKA WEB.

Considering the capacity limitations of the servers and devices, and the multiple use by many people at the same time, you are responsible not to use AREEKA WEB in any way that leads to sabotage or exceed the capacity of the server hardware of the AREEKA WEB network or any networks connected to any of its servers. For example, it is your responsibility not to undertake any act that would impose an unreasonably disproportionately large load on the available infrastructure or bandwidth of AREEKA WEB.

You shall not attempt to disrupt the operation of the Service by any method, including through use of viruses, Trojan horses, worms, time bombs, denial of service attacks, flooding or spamming.

You shall not attempt to gain unauthorised access to any user accounts or computer systems or networks, through hacking, password mining or any other means.

You shall not use any robot, scraper or other means to access the Service for any purpose.

You agree to notify AREEKA WEB immediately of any unauthorized use of your Account Access or any other concern for breach of your account security.

You agree, confirm and acknowledge that AREEKA WEB will not be liable for any loss or damage that incurred as a result of someone else using your account, either with or without your consent and/or knowledge.

You agree, confirm and acknowledge that you are solely and fully liable and responsible for all activities performed using your Account Access. You further acknowledge and agree that AREEKA WEB will hold you liable and responsible for any damage or loss incurred as a result of the use of your Account Access by any person, whether authorised by you or not, and you agree to indemnify AREEKA WEB for any such damage or loss.

You agree and commit not to use the account or Account Access of any other person for any reason.

You agree and confirm that your use of the Platform, including the Therapist Services, are for your own personal use only and that you are not using the Platform or the Therapist Services for or behalf of any other person or organisation.

You agree and commit not to interfere with or disrupt, or attempt to interfere with or disrupt, any of AREEKA WEB’S systems, services, servers, networks or infrastructure, or any of the Platform's systems, services, servers, networks or infrastructure, including, without limitation, obtaining unauthorised access to the aforementioned.

You agree and commit not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the Platform and your relationship with the Therapist and AREEKA WEB.

If you receive any file from AREEKA WEB, or from a Therapist, whether through the Platform or not, you agree to check and scan the file for any virus or malicious software prior to opening or using the file.

Payment

Any payment you make for the use of the Services is used to compensate AREEKA WEB for its software development, overhead, administrative services and other corporate costs and fees, including transaction fees for credit card usage.

AREEKA WEB does not hold itself out as your direct Therapist for the therapy services you receive. That is the role of your licensed, network accredited Therapist. You agree to pay all fees and charges associated with your Account on a timely basis in accordance with the fee schedule, and the terms and rates published by AREEKA WEB from time to time. Such fees and charges (including any taxes and late fees, as applicable) may be charged to the credit card you provided during the initial setup of your Account. You agree to maintain valid credit card information in your Account. By providing AREEKA WEB with credit card information, you authorise AREEKA WEB to bill and charge your credit card.

Therapists

“Therapists” use the platform as specialists in their fields as psychiatrists, or psychologists, or mental health professionals, or counselors, and who have one or all of the following: training, qualifications, experience, skills and certificates of scientific background, and they are sufficient and appropriate in their field.

The Therapists who use the platform are not employees of AREEKA WEB, nor do they act as AREEKA WEB’s agents or representatives. AREEKA WEB only facilitates the connection between you and the Therapists, and is not, in any way, involved, either directly or indirectly, in any interaction between a psychiatrist/psychologist/counselor or any third party and expert. AREEKA WEB is not responsible for implementing any applied agreement between you and the Therapists, including any agreement of remuneration. You alone are responsible for any such agreement. If there is any dispute between you and any one of the Therapists related to transactions made through the platform or the website, you exempt AREEKA WEB and her subsidiaries, institutions, officials, employees and agents of any claims or issues you may have against or related to Therapists.

In order to receive approval to practice using the AREEKA WEB Network, the applying Therapist must be found to be in compliance with the policies and procedures of AREEKA WEB and must receive written approval from AREEKA WEB. This verification process includes, but is not limited to:

1. Verification of licensure. The Therapist holds a valid, current license to practice.

2. Verification of proper education and degree.

3. Verification of any applicable specialised training. Written verification is needed for the completion of any specialised training the Therapist has received from the school or training program that provided the training.

Your relationship with the Therapist is strictly with the Therapist. AREEKA WEB is not involved in the Therapist-client relationship and does not interfere, validate or control the Therapist’s treatment unless advocating on behalf of You when following up on a particular complaint.

You are always advised to exercise a high level of care and caution in your interactions with  AREEKA WEB’s Network of Therapists, just as you would when making any mental health or medical decisions. You should never disregard, avoid, or delay obtaining medical advice from your primary doctor or other qualified healthcare Therapist, or by using or combining AREEKA WEB with traditional face-to-face appointments, solely because of information you saw on the AREEKA WEB site or advice you received through an AREEKA WEB Network Therapist. AREEKA WEB supports a holistic approach to mental health and the choices you have to create for the best therapeutic journey that matches your individual needs.

Intellectual property

All of the content available on or through the Service, including but not limited to, the source code, software, specifications, pictures, signs, and audio files, are the property of AREEKA WEB or its licensors and is protected by copyright, trademark, patent, trade secret and other intellectual property law. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received through the Service to any third party. All software and accompanying documentation made available for download from the Service is the copyrighted work of AREEKA WEB or its licensors. Any copy made of information obtained through the Service must include all applicable copyright notices.

"AREEKA WEB" is a copyrighted term. All rights reserved. Subject to the terms of this Agreement, AREEKA WEB hereby grants you a limited, revocable, non-transferable and non-exclusive license to use the software, network facilities, content and documentation on and in the Service to the extent, and only to the extent, necessary to access and use the Service.

The license granted herein does not permit you to, and you agree not to: (i) modify, translate, reverse engineer, disassemble, decompile or create derivative works of the Service or allow a third party, whether directly or indirectly (including, but not limited to the direct or indirect use of wizards, agents, bots, or other utilities), to modify, translate, reverse engineer, disassemble, decompile or create derivative works of the Service; or (ii) transfer, distribute, sell, lease, rent, disclose or provide access to the Service to any third party or use the Service to provide service bureau, time sharing or other services to third parties.

Disclaimers

Access to the service and the information contained therein is provided “As Is” and “As Available” without any warranty of any kind, express or implied. To the fullest extent permissible pursuant to applicable law, AREEKA WEB disclaims all warranties of any kind, either express or implied, including, but not limited to, any implied warranties of title, merchantability, fitness for a particular purpose, or non-infringement.

Without limiting the foregoing, AREEKA WEB does not warrant that access to the service will be uninterrupted or error-free, or that defects, if any, will be corrected. You expressly agree that your use of the service and your reliance upon any of its contents is at your sole risk.

You shall be solely and fully responsible for any damage to the service or any computer system, any loss of data, or any improper use or disclosure of information on the service caused by you or any person using your username or password. AREEKA WEB cannot and does not assume any responsibility for any loss, damages or liabilities arising from the failure of any telecommunications infrastructure, or the internet, or for your misuse of any protected health information, advice, ideas, information, instructions or guidelines accessed through the service.

Limitations of liability

In the event of any problem with the service or any of its content, you agree that your sole remedy is to cease using the service. Under no circumstances shall AREEKA WEB, any AREEKA WEB licensor or supplier, or any third party who promotes the service or provides you with a link to the service, be liable in any way for your use of the service or any of its content, including, but not limited to, any errors or omissions in any content, any infringement by any content of the intellectual property rights or other rights of third parties, or for any loss or damage of any kind incurred as a result of the use of any content.

Under no circumstances shall AREEKA WEB, its licensors or suppliers of non-medical/mental healthcare services or any third party who promotes the service or provides you with a link to the service, be liable for any punitive, exemplary, consequential, incidental, indirect or special damages (including, without limitation, any personal injury, lost profits, business interruption, loss of programs or other data on your computer or otherwise) arising from, or in connection with, your use of the service, whether under a theory of breach of contract, negligence, strict liability, malpractice or otherwise, even if AREEKA WEB have been advised of the possibility of such damages.

If the applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.

This section (limitation of liability) shall survive the termination or expiration of this Agreement.

Hyperlinks

Any link (including a hyperlink, button or referral device of any kind) used in the Service is provided for your use and convenience. The appearance of a link does not constitute an endorsement, recommendation or certification by AREEKA WEB, nor should the presence of a link in any way be construed as a suggestion that any third party website has any relationship to AREEKA WEB. AREEKA WEB does not endorse the content on any third-party websites. AREEKA WEB is not responsible for the content of linked third-party websites or third-party advertisements, and does not make any representations regarding its content or accuracy. AREEKA WEB does not knowingly link to websites that may infringe on valid and existing trademarks, service marks, copyrights or patents. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such websites.

International use

The AREEKA WEB Platform advises both its Client/Users and practicing Platform Therapists to be aware of and respect and comply with the local laws of any international based Client.

Privacy and security

Protecting and safeguarding any information you provide through AREEKA WEB is extremely important to AREEKA WEB. Information about AREEKA WEB’s security and privacy practices can be found in its ‘Privacy Policy’.

By agreeing to this agreement, and/or by using the platform, you are also agreeing to the terms of the privacy policy. The privacy policy is incorporated into and deemed a part of this agreement. The same rules that apply regarding changes and revisions of this agreement also apply to changes and revisions of the privacy policy.

You affirmatively consent to the fact that AREEKA WEB's Clinical Oversight Personnel will, as needed, review your particular "Session Transcripts" or "Rooms" for the following purposes:

1. During your on-boarding and during the Therapist matching process to ascertain you are able to successfully engage with the Therapist. This access to only de-identified information may be accomplished using an AREEKA WEB on-boarding specialist and not a Therapist;

2. To review your complaints about a particular issue/instance that you report about your Therapist or about a particular language intention with your Therapist;

3. For your safety concerns or complaints of unethical Therapist practices;

4. To transition you to a new Therapist or if your account is non-responsive or inactive for an extended period of time;

5. You consent to AREEKA WEB to search for trends and patterns that may affect the quality of the Services provided to you or the practices of the Therapists. If your particular complaint requires a review of Session Transcripts in the original form, you consent to an AREEKA WEB Licensed Oversight Therapist accessing your account only to respond to your particular complaint or raised issue.

6. You Consent to AREEKA WEB recording your calls to Customer Service.

You affirmatively grant AREEKA WEB permission to have your Therapist periodically provide non-content based clinical assessments of your progress to AREEKA WEB. You understand that AREEKA WEB provides the Therapists with clinical assessment tools that serve to provide information on your mental health and well-being; and that results can be seen by your Therapist to discuss with you.

All data collected by AREEKA WEB through your use of the Services remains the sole property of AREEKA WEB. AREEKA WEB may share some or all of this data with third parties in connection with joint or outside research, analytics, or similar purposes. Research data is used in non-identifiable aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally. You shall not request that AREEKA WEB remove or delete any such data.

AREEKA WEB’s Terms of Use are clear on what consent we seek with regards to your data, and prior to your engagement with your Therapist, you review and agree to a further “informed consent” process.

Unlike some data platforms, AREEKA WEB cannot erase private health data directly upon a Client’s request, as it may be considered essential for other medical file retention purposes.

You acknowledge that AREEKA WEB must store all personal data as required by law, typically for no less than 10 (ten) years, and may not delete such medical records data, even upon your direct request.

You agree that the email username you provide can be used by AREEKA WEB to send you marketing emails and/or offers from AREEKA WEB.

Indemnity

You agree to indemnify AREEKA WEB, and/or any of its affiliates and its officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of AREEKA WEB.

Termination

AREEKA WEB may suspend or terminate your access to the Service at any time, for any reason or for no reason at all. AREEKA WEB has the right (but not the obligation) to refuse to provide access to the Service to any person, agency or organisation at any time, for any reason or for no reason at all, at its sole discretion. AREEKA WEB reserves the right to change, suspend, or discontinue all or part of the Service, temporarily or permanently, without prior notice.

Disputes

These terms and conditions and the AREEKA WEB Site are governed by the Lebanese laws.

Any dispute or claim relating in any way to your use of the AREEKA WEB Service will be resolved by the Lebanese courts.

General conditions

AREEKA WEB’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held by a court of competent jurisdiction to be illegal, invalid, unenforceable, or otherwise contrary to law, the remaining provisions of these Terms will remain in full force and effect. Notices required to be given to you by AREEKA WEB may be delivered by electronic mail to the address provided during the creation of your Account. These Terms constitute the entire Agreement between AREEKA WEB and yourself regarding the Service, and supersede and replace any prior agreements you and AREEKA WEB might have regarding the Service. AREEKA WEB may revise these Terms from time to time without notice to you. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. We encourage you to read the Terms periodically.


These Terms of Use were last updated on August 1, 2021 and are deemed effective as amended as of this date.
